By accessing or using the TranslatePlus API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

TranslatePlus ("we", "us", or "our") provides a translation API platform for developers and businesses. These Terms apply to all users of the Service, including but not limited to developers, businesses, and end-users.

2.1 Account Creation

• You must provide accurate and complete information when creating an account

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

2.2 Account Restrictions

• One person or legal entity may maintain only one account
• Accounts cannot be shared or transferred without our written permission
• We reserve the right to suspend or terminate accounts that violate these Terms

3.1 Acceptable Use

• You may use the API only for lawful purposes
• You must comply with all applicable laws and regulations
• You must not use the API to translate illegal, harmful, or offensive content
• You must implement appropriate rate limiting and error handling
• You must not attempt to bypass our security measures or rate limits

3.2 Prohibited Activities

You agree NOT to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to harm, threaten, or harass others
• Share your API keys with unauthorized third parties
• Use the Service to spam or send unsolicited communications
• Attempt to overload or disrupt our servers or network infrastructure
• Scrape, crawl, or use automated means to access the Service excessively
• Use the Service to create a competing translation service
• Resell or redistribute API access without a commercial partnership agreement

3.3 API Keys and Security

• Keep your API keys confidential and secure
• Never expose API keys in client-side code or public repositories
• Rotate your API keys periodically for security
• Report any suspected security breaches immediately

4.1 Pricing and Payment

• Our current pricing is available on our Pricing page
• We reserve the right to change our pricing with 30 days notice
• All payments are processed securely through third-party payment processors
• You agree to pay all charges incurred under your account

4.2 Credits System

• Translation services are charged based on character count
• Credits are deducted from your account for each API request
• Unused credits do not expire unless your account is inactive for 12+ months
• Credits are non-refundable except as required by law

4.3 Free Tier

• Free tier accounts receive a monthly allocation of free credits
• Free credits reset at the beginning of each billing cycle
• We reserve the right to modify or discontinue the free tier at any time
• Free tier usage is subject to additional rate limits

4.4 Refunds

• Credit purchases are generally non-refundable
• Refunds may be issued at our sole discretion for service outages or errors
• To request a refund, contact our support team within 14 days of purchase

5.1 Service Level

• We strive to maintain 99.9% uptime, but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions beyond our reasonable control

5.2 Technical Support

• Support is provided via email and our support portal
• Response times vary based on your subscription tier
• We do not provide phone support

6.1 Our Property

• The Service, including all content, features, and functionality, is owned by TranslatePlus
• Our trademarks, logos, and brand features are protected by intellectual property laws
• You may not use our trademarks without our prior written permission

6.2 Your Content

• You retain all rights to the content you submit for translation
• You grant us a limited license to process your content for translation purposes
• We do not claim ownership of your translated content
• We may use anonymized usage data to improve our Service

7.1 Data Processing

• We process your data in accordance with our Privacy Policy
• We implement industry-standard security measures to protect your data
• We do not sell your data to third parties
• Translation requests are processed and not permanently stored unless required by law

8.2 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSLATEPLUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless TranslatePlus, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content and its use through the Service

11.1 By You

• You may terminate your account at any time through your account settings
• Unused credits will be forfeited upon account termination
• You remain responsible for any charges incurred before termination

11.2 By Us

• We may suspend or terminate your account for violation of these Terms
• We may terminate accounts that have been inactive for over 12 months
• We will provide notice when reasonably possible before termination
• We reserve the right to refuse service to anyone at any time

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending email notifications for significant changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where TranslatePlus is registered, without regard to conflict of law provisions.

13.2 Dispute Resolution

• We encourage resolving disputes through direct communication first
• For unresolved disputes, parties agree to attempt mediation before litigation

14.1 Entire Agreement

These Terms, along with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and TranslatePlus.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
